1. Who these terms apply to

These terms govern your use of levelcfo.com (the "Site") and any free tools, content, calculators, or downloadable resources we provide through it. They are between you and Level CFO ("Level," "we"), a business operating from 447 Broadway 2nd Floor #1301, New York, NY 10013. By using the Site you agree to these terms. Paid client engagements are governed by a separate written engagement agreement, which controls in case of conflict with these terms.

2. What we provide

Level offers fractional CFO, bookkeeping, and financial analytics services delivered by experienced CFOs and accelerated by AI, services for service businesses. The Site provides marketing content, free calculators, benchmark reports, and ways to contact us or book a meeting. The Site and its free tools are provided "as is" for educational and informational purposes only.

3. Not professional advice

Information on the Site, in our blog, and produced by free tools (calculators, diagnostics, benchmark reports) is general guidance, not legal, tax, audit, investment, or accounting advice. Numbers and benchmarks are illustrative and based on aggregate datasets. Do not act on Site content alone — consult qualified professionals for decisions that affect your business.

4. Forms, email, and phone collection

When you submit a form on the Site (audit request, contact form, lead-capture modal, newsletter signup), you consent to us using the information you provide to respond to you, send the resource you requested, and (if you opt in) send periodic newsletters with content we think you'll find useful. Phone numbers are optional and used only for follow-up about your inquiry. You can opt out of newsletters at any time using the unsubscribe link in each email or by emailing [email protected]. Our handling of personal data is described in our Privacy Policy.

5. Acceptable use

You agree not to:

• Use the Site to violate any law or third-party right.
• Scrape, copy, or republish substantial portions of the Site or its data without written permission.
• Attempt to bypass authentication, rate limits, or access controls (including reverse-engineering our APIs or functions).
• Submit forms with automation, false identities, or someone else's contact information.
• Upload malicious code or attempt to disrupt the Site.

6. Intellectual property

The Site, our brand, logo, content, frameworks (including the CLEAR Framework and the Level Index), tools, and methodologies are owned by Level. You may share blog posts and links with attribution. You may not use our content in derivative commercial products (including AI training datasets) without written permission. Brief quotations with attribution to levelcfo.com are welcome.

7. Third-party links and services

The Site links to third-party sites and embeds third-party widgets (Calendly, YouTube, etc.). We are not responsible for the content or privacy practices of those services. Use them at your own risk and review their terms.

8. Disclaimer and limitation of liability

The Site and free tools are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Level is not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill arising from use of the Site or its content. Our total aggregate liability arising from your use of the Site is limited to USD $100. This section does not limit liability for fraud, gross negligence, or willful misconduct.

9. Changes

We may update these terms as our services and the law evolve. Material changes will be flagged at the top of the page. Continued use of the Site after a change means you accept the updated terms.

10. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising from these terms or your use of the Site will be resolved by binding arbitration in New York County, New York, administered under the rules of JAMS, except that either party may seek injunctive relief in court for IP or confidentiality matters. You and Level each waive the right to a jury trial and to participate in any class action.
